What decisions are published?
Release on Parole and Parole Cancellation
Two types of Board decisions that require publication on the website, are decisions where the Board has determined to either make a Parole Order or cancel a Parole Order, however only where the prisoner’s sentence imposed is for a period of 5 years or more and for a serious offence.
A serious offence regarding parole is defined in Schedule 2 of the Sentence Administration Act 2003 (WA).
In addition, all decisions to release or cancel parole where an offender has a sentence of 10 years or more will be published, regardless of whether the offence is a ‘serious offence’ as outlined above.
Decisions to release or cancel parole relating to prisoners for which there is a level of public interest, the publication of the Board’s decision will be identified and approval sought from the Chairperson prior to any publication.
Post Sentence Supervision Order
Another Board decision that requires website publication is when the Board determines to impose a Post Sentence Supervision Order (PSSO) on a prisoner, but only where the sentence imposed is for a period of 5 years or more.
A serious offence regarding a PSSO is defined in Schedule 1 of the High Risk Serious Offenders Act 2020 (WA).
Schedule 1 of this Act also provides for the:
- Bush Fires Act 1954
- Road Traffic Act 1974
- Children and Community Services Act 2004
- The Criminal Code
- Prostitution Act 2000
In addition, and due to the nature of sexual offences, if the publication of the name of a sex offender could lead to the identification of a victim(s), the prisoner's name is not published.
